The rules for using the software.
These are working release terms for Customizable Desktop Assistant. Final seller details should be completed before accepting public payments.
1. Agreement to These Terms
These Terms & Conditions apply to the purchase, download, installation and use of Customizable Desktop Assistant, referred to as "the Software".
By purchasing, downloading or using the Software, you agree to these Terms.
2. Your Software Licence
A valid purchase gives you a limited, personal, non-exclusive and non-transferable licence to use the edition of the Software that you purchased.
Purchasing the Software does not transfer ownership of our proprietary source code, original branding, original designs or other intellectual property to you.
3. No Sharing or Reselling
Unless we give you written permission, you must not:
- Share, leak, publish or upload our proprietary source code.
- Give paid copies of the Software to other people.
- Share private download links, licences or customer access.
- Resell, rent or commercially redistribute the Software.
- Claim our proprietary software or original project assets as your own.
Third-party and open-source components remain subject to their own licences. Nothing in these Terms removes rights those licences independently give you.
4. Free Updates
Updates released for the edition that you purchased are intended to be available from the official website without an additional update fee.
A separately sold future product, separately branded product or new paid edition is not automatically included unless we specifically state otherwise.
5. Change-of-Mind Refunds
Except where applicable law requires otherwise, purchases are final once digital supply begins.
Where applicable law gives a customer a cancellation period for digital content, immediate supply should only begin after the customer expressly requests immediate supply and acknowledges the effect this has on their cancellation right.
This section does not remove statutory rights relating to faulty or misdescribed digital content.
6. Faults, Support and Refund Requests
If you believe the Software has a genuine fault, contact us through the official Discord support ticket system or support email.
We may request reasonable information needed to investigate the issue, including your order information, screenshots, video, error messages, logs or details about your computer configuration.
Where appropriate, we may first attempt troubleshooting, repair, an update or a replacement.
If the problem cannot be appropriately resolved and you are legally entitled to a refund, price reduction or other remedy, we will provide that remedy.
7. Approved Refunds
Once we agree that a customer is entitled to a refund, the refund will be processed without undue delay and within any time limit required by applicable law.
For UK digital-content rights, an agreed refund must generally be made no later than 14 days after we agree that the customer is entitled to the refund.
Unless the customer expressly agrees otherwise, the refund should normally be returned through the same payment method used for the purchase.
We do not charge a fee for processing a legally required refund.
8. AI Responses
Artificial intelligence can produce incorrect, incomplete or outdated responses.
The Software should not be treated as a guaranteed source of legal, medical, financial, emergency or other safety-critical professional advice.
Users are responsible for reviewing important AI output before relying on it.
9. Desktop Actions
Some features may interact with supported applications, files, computer settings, microphones, cameras and other desktop functions.
You are responsible for the permissions you choose to give the Software and for keeping appropriate backups of important data.
10. Third-Party Services
Some functions may depend on third-party software, models, APIs, operating-system functions or online services.
Those third parties may have their own licences, terms, privacy policies, restrictions or fees.
Third-party products and services can change or become unavailable and we cannot guarantee their permanent availability.
11. Acceptable Use
You must not use the Software to:
- Break applicable law.
- Gain unauthorised access to another person's computer, accounts or data.
- Distribute malware.
- Intentionally damage another system.
- Circumvent our proprietary distribution or licence controls.
12. Intellectual Property
Our proprietary software code, original branding, original website materials and original project assets remain the property of their respective project owner or owners.
Third-party software, names, models, trademarks and assets remain owned by their respective rights holders.
13. Suspension or Termination
We may suspend access to our proprietary paid distribution where a customer materially breaches these Terms, including by distributing paid proprietary copies without permission.
This does not remove rights granted independently by third-party licences or applicable law.
14. Warranty and Liability
To the fullest extent permitted by law, we do not guarantee that every function will always be uninterrupted, error-free or compatible with every third-party program or computer configuration.
Nothing in these Terms excludes or limits liability or consumer rights where the law does not allow them to be excluded or limited.
15. Changes to the Software and Terms
The Software and these Terms may be updated as the project develops.
Material changes should be communicated appropriately and do not remove rights that applicable law does not allow us to remove.
16. Seller and Contact Information
Before the public release, this section must be completed with the correct seller or business name, support contact information and other legally required business information.
